PRINCIPIO DE JUSTICIA UNIVERSAL EN CHAD/ Principle of Universal Justice in Chad

j Por primera vez en la historia se ha aplicado el principio de justicia universal en el continente africano y además por un tribunal del mismo, concretamente en Dakar. La sentencia se ha dictado contra el exdictador chadiano Hissène Habré por crímenes de guerra, torturas, crímenes contra la humanidad, violación y esclavitud sexual. La condena ha sido de cadena perpetua y confiscación de todos sus bienes.

Hissène Habré fue presidente de la República de Chad desde 1982, cuando dio un golpe de estado contra el presidente Goukouni Oueddei, hasta 1990, cuando fue depuesto por el actual presidente Idriss Déby. Durante sus 8 años de gobierno más de 40.000 personas murieron asesinadas y otras decenas de miles torturadas durante su mandato según la Comisión de la Verdad de Chad. La condena que recibió el lunes pasado se ha convertido en un hito histórico para el continente, no solo por condenar a un exdictador africano, sino porque es la primera vez que se aplica el principio de justicia universal en África.

El tribunal que llevo el proceso fue un tribunal ad hoc creado por las Cámaras Africanas Extraordinarias, y suponen un avance en el cumplimiento de la justicia en el continente, que lleva muchos años sufriendo a gobernantes que se dedican a instaurar el terror en sus respectivos países además de a expoliarlos.

Hasta la fecha este principio ha sido activado en varias ocasiones para juzgar a personas que hayan cometido crímenes contra la humanidad y que hayan huido de sus respectivos países para evitar la justicia de los mismos, como el caso Eichmann. Sin embargo, para los países africanos este principio nunca había sido ni invocado ni aplicado en ningún tribunal del continente, lo cual supone un cambio significativo en la aplicación de justicia en el continente. Además, que haya sido un tribunal africano el que haya dictado la sentencia comienza a mostrarnos que África ya no es un continente donde se tiene impunidad absoluta por los actos pasados, lo cual ayudara a su evolución positiva en los próximos años.

Este cambio nos muestra cómo se está produciendo un cambio en la mentalidad global donde los derechos humanos están tomando mayor importancia especialmente en zonas donde anteriormente no la tenían, como en África, donde la población está cada vez más cansada de los regímenes militares autoritarios y poco a poco comienzan a desarrollarse los derechos y libertades de las personas, aunque es un proceso que va muy lento. También en los países asiáticos comienza a verse este despertar, caracterizados uchos de ellos por tener regímenes militares que incumplen sistemáticamente el respeto a los derechos y libertades fundamentales.


jsFor the first time in history, the principle of universal justice has been applied on the African continent by an African Court, specifically in Dakar. The judgment has been against the Chadian ex-dictator Hissène Habré for war crimes, torture, crimes against humanity, rape and sexual slavery. The sentence was life imprisonment and confiscation of all his properties.

Hissène Habré was President of the Republic of Chad since 1982, when he gave a coup d’etat against President Goukouni Oueddei, until 1990, when he was deposed by current President Idriss Déby. More than 40,000 people were killed during his 8 years of Government and tens of thousands tortured during his mandate, according to the Commission of the Truth of Chad. The sentence he received last Monday has become a milestone for the continent, not only for condemning an African dictator, but because it is the first time that the principle of universal justice is applied in Africa.

The Court that took the process was created ad hoc by the extraordinary African Chambers Court, and they represent an advance in the fulfilment of Justice in the continent, which has suffered many years of rulers who are dedicated to establish terror in their respective countries as well as to plunder them.

To date, this principle has been activated on several occasions to try people who have committed crimes against humanity and who have fled their country to avoid them, for example the Eichmann case justice. However, for African countries this principle has never been invoked or applied in any Court of the Mainland, which represents a significant change in the application of justice in the continent. Being an African Court which has rendered the judgment also begins to show us that Africa is not a continent where you have absolute impunity for past acts, which will help their positive evolution in the coming years.

This change shows how a change is taking place in the global mind set where human rights are taking greater importance especially in areas where previously did not have it, as in Africa, where the population is more and more tired of the authoritarian military regimes and slowly begin to develop the rights and freedoms of individuals, although it is a process that is very slow. Also in Asian countries begins to see this awakening, characterized for having military regimes that systematically violate respect for the rights and fundamental freedoms.
